Civil Litigation & Trials

All new lawsuits should receive immediate review by experienced litigation counsel. Our San Francisco trial lawyers provide strategic review of new lawsuits on a same-day basis. The firm's trial lawyers have experience with all types of civil litigation issues and trials in U.S. Federal Courts and in California Superior Courts for the counties of San Francisco and Los Angeles, San Mateo (Redwood City), Santa Clara (San Jose), Alameda (Oakland), Contra Costa (Walnut Creek), Marin (San Rafael) Monterey and Santa Cruz.

Cases in litigation do not always reach trial; and, in our view as trial lawyers, most civil litigation matters should not go as far as a trial. If litigation becomes necessary, Luscutoff, Lendormy & Associates works to avoid expensive court procedures. When possible, attorneys of the firm resolve disputes through strategic compromise, negotiation, mediation or arbitration.

In all civil litigation and trial matters, the firm takes action and develops solutions in ways to minimize costs and maximize speed in the litigation process. Once litigation commences, our litigators look for opportunities to make dispositive motions, sometimes securing judgment or dismissals in cases before expensive discovery or trials are undertaken.

Fields of civil litigation and trial practice include general civil matters, unfair competition, breach of contract, probate litigation, will contests, trust disputes, real estate and premises liability, receiverships, partition actions, unlawful detainer, wrongful eviction and wrongful death actions and business disputes involving deceptive advertising, trade libel, wage and hour violations and general commercial litigation.

Luscutoff, Lendormy & Associates' string of civil litigation and trial lawyer successes began in 1982 when Jean-Yves Lendormy obtained a $175,000 San Francisco jury verdict for a small business client against his business partner. The San Francisco Superior Court verdict included punitive damages against that partner, an excavation contractor.

When the excavation contractor tried to avoid payment of the judgment by filing a Chapter 11 Bankruptcy, Sidney Luscutoff took the matter to trial in the Federal Bankruptcy Court for the Northern District of California in San Francisco and Sid Luscutoff beat the excavation contractor again. Afterwards, the firm provided evidence to the Federal Bureau of Investigation and the United States Attorney which resulted in a criminal bankruptcy fraud conviction against the excavation contractor and his wife.

In 2011 Jean-Yves P. Lendormy  obtained a $61 million mediation award stemming from several lawsuits filed as result of a tragic bus accident involving french tourists.

Litigation matters and especially new lawsuits should be given a high priority and immediate attention. One of our litigation and trial lawyers is always available to provide immediate assistance and advice when a new lawsuit arrives.
