Domestic Partnership Dissolution

In 1999 California enacted legislation recognizing committed same sex relationships and established a system of registered domestic partnerships for that purpose. Since that time, particularly in 2003, the statutory rights and obligations of registered domestic partners have evolved and expanded to include a straightforward procedure for domestic partnership dissolution.

There is now express statutory authority to terminate a domestic partnership and to adjust property rights through domestic partnership dissolution proceedings. Such domestic partnership dissolutions essentially "track" the marital dissolution procedure under the Family Code. In specific circumstances, though, a formal Superior Court proceeding will not be necessary; and the registered domestic partnership can be terminated via a filing with the California Secretary of State.

California's public debate continues - often at a high pitch - on the topic of same sex marriage. And that debate highlights the acute remaining differences between 'marriages' and 'registered domestic partnerships'.
