EB-1.2 Visa for Outstanding Professors and Researchers

As a preliminary note, the employer must file the EB-1.2 petition for an outstanding professor or an outstanding researcher. Luscutoff, Lendormy & Associates works closely with employers as part of the EB-1.2 visa process to steer around and get past obstacles in the regulations governing EB-1.2 visas.

Outstanding professors and outstanding researchers are persons who have been internationally recognized for outstanding achievements in a particular academic field.

A successful candidate for an EB-1.2 visa must have at least three years experience in research or teaching in his or her field. The candidate’s petition must show he or she is entering the U.S. to fill a tenure or tenure track teaching position or will be assuming a comparable research position at an institution of higher education or private organization. If the employer is a private company, the institute, department, or division of the private employer must have a history of achieving documented accomplishments in an academic field and must employ at least three persons full time in research activities.
