Legal Separation

The Family Code allows family lawyers at Luscutoff, Lendormy & Associates to file Legal Separation petitions in the Superior Courts of the San Francisco Bay Area on the same bases as dissolution actions.

Relationships, including marriages, sometimes reach a point where a change must happen. However, for religious and other personal reasons a spouse may not wish to terminate marital status. The family law attorneys at Luscutoff, Lendormy & Associates can obtain a judgment of legal separation which serves that purpose. That judgment of legal separation leaves the parties married 'in name only', with no spousal duties of care and support except as contained in the court's judgment. Family Code Sections 772, 4300, et. seq.

A judgment of legal separation does not terminate marital status; but the judgment will adjudicate financial issues between the parties. Note: The entry of such a judgment will also materially affect such things as the rights of intestate succession and inheritance under the Probate Code.
